A Truth or Consequences woman is facing charges of abandoning her children following an incident that took place on Wednesday afternoon, March 7.
According to an affidavit for arrest filed in Sierra County Magistrate Court, Truth or Consequences Police Officer Sam Hanna responded to a residence in the 800-block of East Fourth Street just after 2:45 p.m., on March 7, after a man driving along the street noticed two small children crying.
“The female child was only wearing pants and the male child was nude, covered with a blanket, lying in the dirt,” Officer Hanna states.
Officer Hanna contacted the local Children, Youth & Families Division and requested a CYFD advocate at his location.
The young girl went into the residence and retrieved clothes for her little brother. The little girl then told Officer Hanna that her mother, later identified as 29-year-old Linda J. Lindsay of Truth or Consequences, had possibly left with a man.
Moments after the CYFD advocate arrived on scene, Ms. Lindsay’s oldest son was dropped off by the school bus and stated that his mother may have gone to the store “because we need food,” reads the court document.
The three children were placed in CYFD’s custody and transported to the police department.
Sierra County Magistrate Court Judge Thomas Pestak signed the affidavit for the arrest warrant for Ms. Lindsay on Friday, March 9 – two days after the incident. According to the court document, Ms. Lindsay still had not “contacted the police department or called 911 to report her children missing, or their whereabouts.”
Linda Lindsay is facing two counts of abandonment or abuse of a child, both of which are misdemeanors.
Lindsay was subsequently arrested and incarcerated at the Sierra County Detention Center with a $2,000 cash-only bond.
